These Terms and Conditions (“Terms”) govern your access to and use of the Site. Please read them carefully. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Scope — What These Terms Do and Do Not Cover

These Terms govern your use of this website. They are not a contract for the purchase of products or services.

Any purchase of shutters, blinds, shades, draperies, or installation services is governed by the separate written quote, sales order, contract, or invoice you sign or accept, together with any applicable manufacturer warranty. If anything in these Terms conflicts with the terms of a signed sales agreement, the signed sales agreement controls with respect to that purchase.

Nothing on this Site constitutes an offer to sell. Submitting a form, requesting a quote, or receiving an estimate does not create a binding contract until we and you have both agreed to a written order.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use this Site or to request a consultation, quote, or service. By using the Site, you represent that you meet these requirements.

3. Quotes, Estimates, Pricing, and Product Information

Estimates require in-home measurement. Because our products are custom-made to fit your windows, any pricing discussed by phone, email, or through the Site is preliminary. Final pricing is determined after a professional in-home measurement and consultation.

Pricing is subject to change. Prices, promotions, and product availability described on the Site may change at any time without notice and are not guaranteed until confirmed in a written quote. Promotional offers may have conditions, minimums, and expiration dates.

Colors and appearance. Product images, color swatches, wood tones, and fabric finishes shown on the Site are provided for general reference only. Screen settings, monitor calibration, lighting, and photographic conditions mean that on-screen appearance may differ from the actual product. We strongly recommend viewing physical samples before making a color or material selection. We are not responsible for differences between on-screen images and delivered products.

Product descriptions. We work to keep product descriptions, specifications, and availability accurate, but we do not warrant that this information is complete, current, or error-free. Manufacturers may change specifications, materials, or availability at any time. We reserve the right to correct errors and to decline or cancel orders placed based on inaccurate information.

Measurements. Where we perform the measurement, we stand behind the fit as described in your sales agreement. Where you supply measurements yourself, you are responsible for their accuracy, and custom products manufactured to your measurements are generally not returnable.

4. Contacting Us Through the Site

When you submit a form on the Site or call us, you consent to our contacting you by phone, text, or email in response to your inquiry. Consent to receive marketing calls or texts is not a condition of purchase, and you may opt out at any time as described in our Privacy Policy.

You agree that the information you submit is accurate and that you are authorized to provide it — including any phone number you enter and any service address you identify. Do not submit forms on behalf of another person without their permission.

Do not transmit sensitive personal information (such as Social Security numbers, financial account numbers, or health information) through the Site’s forms.

5. Acceptable Use

The “Yocum Shutters & Blinds” name and logo are our trademarks. You may not use them without our prior written permission.

Limited license. We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your personal, non-commercial use in evaluating our products and services. You may print or download individual pages for that purpose provided you retain all copyright and proprietary notices. This license does not include any right to modify, republish, distribute, or create derivative works from Site content.

Third-party trademarks. Product names, brand names, and manufacturer trademarks appearing on the Site are the property of their respective owners. Their appearance on the Site does not imply any endorsement of Yocum by those owners beyond any dealer or distributor relationship we may hold.

Project photography. Photographs of completed installations are used with permission or depict our own work. If you believe an image on the Site infringes your rights, contact us and we will address the concern promptly.

7. Reviews, Testimonials, and Ratings

The Site displays customer reviews and aggregated ratings sourced from third-party review platforms. These reflect the opinions of the individuals who wrote them, not Yocum. We do not control or edit third-party reviews, and we do not guarantee that any particular result described in a review will be typical or achieved in your project.

Awards and recognitions displayed on the Site were conferred by the awarding organizations and reflect the criteria applied by those organizations at the time.

We do not warrant that the Site will be uninterrupted, timely, secure, or error-free; that defects will be corrected; that the Site is free of viruses or other harmful components; or that information on the Site is accurate, complete, or current.

This Section applies to the Site only. It does not limit, disclaim, or affect any warranty we provide on products or installation services under a signed sales agreement, or any manufacturer warranty accompanying a product you purchase. It also does not disclaim any warranty that cannot be disclaimed under applicable law.

11. Limitation of Liability

To the fullest extent permitted by law, Yocum Shutters & Blinds and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of or inability to use the Site — whether based in contract, tort, negligence, strict liability, or any other theory, and even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Site will not exceed one hundred dollars ($100.00).

This Section applies to the Site only and does not limit our liability under any signed sales agreement for products or installation services. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability for fraud, personal injury caused by negligence, or any other liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Yocum Shutters & Blinds and its owners, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, your violation of any applicable law, or your infringement of any third party’s rights.

13. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws principles.

You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Chester County, Pennsylvania, and you consent to the personal jurisdiction of those courts. This Section does not affect any dispute resolution provision contained in a signed sales agreement, which will control as to disputes concerning that purchase.

14. Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page and updating the “Last Updated” date. Changes take effect when posted. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. Please review this page periodically.

15. General Provisions

Severability. If any provision of these Terms is found unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

No waiver. Our failure to enforce any provision of these Terms is not a waiver of that provision or of any other right.

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Yocum regarding your use of the Site, and supersede any prior understandings on that subject. They do not supersede any signed sales agreement.

Assignment. You may not assign or transfer your rights under these Terms. We may assign these Terms without restriction.

Survival. Sections concerning intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive any termination of your use of the Site.
